Pennsylvania Car Accident Legal Center

Defective airbag injury? Our Pennsylvania lawyers can help!

Defective air bags can injure, rather than provide protection. Air bags are automatic safety mechanisms installed in vehicles that deploy instantly in the event of a crash. When an air bag fails to operate properly, it is defective. A defect air bag can result in injuries over and above those sustained in the accident itself.

When a defective air bag causes injury or death, the injured person may have a products liability claim against the manufacturer, supplier, distributor or retailer of the air bag.

There are several reasons why air bags cause injury and death:

  • Overly-aggressive air bags. An air bag that deploys too fast (sometimes at speeds in excess of 200 miles per hour) and too far into the occupant space, may cause severe head injuries, brain damage, and even decapitation.
  • Oversized air bags. Air bags that are too large can deploy too far into the occupant space, which can also result in severe head injuries, brain damage, and even decapitation.
  • Untethered air bags. Tethers are cloth strips that are sewn on the inside of the air bag to limit movement during the inflation process. When untethered, movement isn't limited which can cause the air bag to come too far into the occupant space and cause serious injuries.
  • Low deployment threshold. Air bags are not necessary in low-speed crashes. However, when an air bag is set to deploy in a low speed crash, many people sustain injuries that they would not have encountered had the air bag not deployed.
  • System malfunctions. Sometimes, a defective electrical system or sensors cause an air bag to unnecessarily deploy on ignition or when encountering a common roadway obstacle, like a pothole. On the other hand, defective electrical systems or sensors can result in the air bags failing to deploy when necessary.
