Settlement reached for motorcyclist injured by tractor trailer making wide turn

Our client, a motorcyclist, was injured when a tractor-trailer driver took a wide turn, blocked our client's lane, and forced him to squeeze around the truck on the berm. He was injured when he was forced to leave his lane to avoid hitting the truck and subsequently struck a van behind the truck.

Our lawyers reached a settlement at a mediation while awaiting trial. Although the motorcycle never made contact with the tractor-trailer, the bulk of the settlement was paid by the freight company who employed the tractor-trailer driver.

Our client was driving on a severely deteriorated road that had a history of accidents on it. The poor road surface condition included wheel rutting which allowed water to accumulate in the wheel ruts in heavy rains. Our client hit the water in these ruts and hydroplaned. Road defect results in death of 23 year old woman

Our attorney represented a case that involved the unfortunate death of a 23 year old woman. Her death was caused by inadequate surface and subsurface drainage conditions on an area of State Route 22, Blair County. An identified problem was never corrected and water was allowed to seep out of the pavement onto the traveled portion of the roadway. Nearby residents testified that this problem had existed for years before the accident. During winter, as a result of the road defect, water in this area would freeze into icy conditions even when other areas of the roadway would be clear and dry. This fatal accident was a direct result of the Pennsylvania Department of Transportation's failure to act appropriately on an identified problem. On the eve of trial, a financial settlement was reached on behalf of the clients.

Our attorney successfully concluded a lawsuit for the widow of a trucker who died in an accident on the Pennsylvania turnpike. The fatal accident occurred because the dirt covered trailer was not visible to the niece. Although she saw the bright lights of the tractor shining directly towards her, she could not see the trailer which was still across her lane of travel until it was too late for her to stop.

In this case, a trucking company violated Federal Safe Trucking Standards by failing to discipline and discharge a driver with multiple accidents. The driver subsequently jack- knifed hitting our client's vehicle and causing our client to lose a finger, sustain a brain injury and internal injuries with colostomy.

The case was filed in Federal District Court for the Western District of Pennsylvania. It was settled before trial, in favor of our client.
