Knee injury proven through investigation

As the result of an automobile accident, a client sustained multiple traumatic injuries. In addition to photographing the client's serious injuries, our investigator took photos of the client's knee which had also suffered trauma. The knee was very swollen and black and blue. At the time, not much attention was paid to the knee due to the severity of the other injuries.

Also, the investigator had not only taken photos of the damage to the outside of the car, but had also taken photos of the damage to the inside of the car where the client's knees had hit into the console.

After approximately six months, the client was still experiencing knee pain and subsequently, had a knee operation. The defendant's insurance company refused to pay damages for the knee injury. They argued that the injury was not related to the auto accident and that the client did not have medical treatment on the injury at the time of the accident.

However, once we produced the photographs of the damage to the inside of the car and photographs of the severe knee injury to the doctor, we were able to prove that the injury was sustained at the time of the accident. The defendant's insurance company later paid on the claim. Preserving perishable evidence such as the injured person's bruises or damage to the inside of a car can be critical to a case.

Whose Fault Is It? The investigation answers the question

A driver came to a stop sign and was attempting to make a left turn onto the roadway. Unfortunately, he had virtually no ability to see down the road to his left due to very overgrown trees blocking his sight distance. The driver pulled into the path of our client who was driving on the through road and had the right of way.

As a result of the accident, our client sustained very serious injuries. Most people think that the only responsible party in this accident is the driver who pulled out from the stop sign. However, in this particular accident, the environment also caused injury to our client by restricting the view of both drivers.

An investigator went out and immediately took photographs and videos of the scene. The tape clearly showed a sight distance problem and the driver's inability to see our client due to the trees which were not properly trimmed by the governmental entity responsible for maintenance of the roadway and the foliage.

It was determined that, not only was the driver who hit our client responsible for the accident, but so was the governmental entity responsible for the maintenance of the roadway and the foliage along the roadway. Our client collected damages from both parties.
